Visit Exeter Membership Terms and Conditions

1. Membership Agreement

By applying for and purchasing a Visit Exeter membership package, you agree to these Terms & Conditions and enter into a membership agreement with Visit Exeter, a service provided by Exeter City Council.

Membership is valid for a period of 12 months from the date the membership listing is activated on the Visit Exeter website unless otherwise agreed in writing.

2. Membership Benefits

Members will receive the benefits outlined in the membership package selected at the time of purchase.

Visit Exeter reserves the right to amend membership benefits where necessary due to operational requirements or changes in services. Where practical, members will be notified of any significant changes.

3. Membership Fees and Payment

Membership fees are payable in full upon receipt of an invoice and within the payment terms stated on the invoice.

Visit Exeter reserves the right to withhold, suspend or remove membership benefits until outstanding invoices have been settled.

Membership fees are non-refundable once membership has commenced.

4. Supply of Information

Members are responsible for ensuring that all information supplied to Visit Exeter, including business descriptions, contact details, opening times, prices, facilities, event information and promotional content, is accurate, up-to-date and lawful.

Visit Exeter accepts no responsibility for errors or omissions in information supplied by members.

Members must notify Visit Exeter as soon as reasonably practicable of any significant changes to their business information.

5. Images, Photography and Intellectual Property

The member warrants that they own, or have obtained all necessary rights, permissions, licences and consents required for the use, publication and distribution of any photographs, videos, graphics, logos, text or other content supplied to Visit Exeter.

By providing such content, the member grants Visit Exeter a non-exclusive, royalty-free licence to use, reproduce, publish, distribute, adapt, resize and display the content for the purposes of promoting:

• The member's business;
• Visit Exeter;
• Exeter and the surrounding area as a visitor destination;
• Tourism, cultural and economic development activity undertaken by Exeter City Council.

This licence includes use across:

• The Visit Exeter website and associated digital platforms;
• Social media channels;
• E-newsletters;
• Press and media activity;
• Printed promotional materials;
• Presentations, publications and marketing campaigns;
• Third-party tourism and media partners promoting Exeter as a destination.

The member confirms that any individuals featured in supplied photography or video have granted the necessary permissions for promotional use where required by law.

The member agrees to indemnify and hold harmless Visit Exeter and Exeter City Council against any claims, losses, damages, legal costs or expenses arising from a breach of these warranties, including claims relating to copyright infringement, intellectual property rights, image licensing or data protection.

Visit Exeter reserves the right to refuse, remove or cease using any content at its sole discretion.

6. Promotional Activity

Visit Exeter may use information, editorial content, event listings, images and other media supplied by members in destination marketing activity intended to promote Exeter and its visitor economy.

Whilst every effort will be made to promote members fairly and appropriately, Visit Exeter cannot guarantee any specific level of exposure, visitor enquiries, bookings or commercial outcomes.

7. Website Listings

Visit Exeter aims to publish new listings promptly following receipt of all required information and payment where applicable.

Visit Exeter reserves the right to edit content for clarity, consistency, style, legal compliance and search optimisation.

8. Membership Communications

By becoming a member, you agree to receive communications relating to your membership, renewal notices, industry updates, partnership opportunities and relevant Visit Exeter news.

Members may opt out of non-essential marketing communications at any time, although important membership-related communications will continue to be sent where necessary.

9. Renewal and Cancellation

Visit Exeter will be in contact when membership is due for renewal, and will not automatically renew any memberships.

Members may cancel their membership at any time, however no refunds will be provided for any unused portion of the membership period.

Visit Exeter reserves the right to terminate membership immediately where a member:

• Fails to pay outstanding fees;
• Supplies false or misleading information;
• Damages the reputation of Visit Exeter or Exeter City Council;
• Breaches these Terms & Conditions;
• Operates in a manner contrary to relevant legislation or regulatory requirements.

10. Limitation of Liability

Visit Exeter shall not be liable for any indirect, consequential or economic loss arising from membership, including loss of business, revenue, profits, goodwill, opportunities or anticipated savings.

Nothing in these Terms & Conditions excludes liability for death or personal injury caused by negligence, fraud or any liability that cannot lawfully be excluded.

11. Data Protection

Visit Exeter and Exeter City Council will process personal information in accordance with applicable UK data protection legislation and the Council's Privacy Notice.
